Terms and Conditions

These Terms and Conditions govern, on the one hand, the terms of use, access, and registration on the website https://www.fourvenues.com/es (the “Terms of Use” and the “Website,” respectively) by any person (the “User” or “Users”), as well as the conditions for purchasing tickets for events offered on the Website (the “Purchase Terms”). The Terms of Use and the Purchase Terms may collectively be referred to as the “Terms.”

PREAMBLE– IDENTIFICATION

Through its Website, Fourvenues enables Users to access information on various national and international events organized by different promoters (the “Events”), for which Users may purchase tickets (the “Tickets”) via the Fourvenues Website.

The Events are organized by various commercial entities whose main business is the organization of all types of events and who wish to manage ticket sales for such events through Fourvenues’ platform or Website (the “Promoters”). Therefore, the organization and/or execution of the Events listed on the Website depend exclusively on the Promoters as the organizers of the Events, without Fourvenues intervening in any aspect of such organization, nor determining the prices or entry conditions for the Events.

SECTION I – TERMS OF USE

By accepting these Terms of Use, the User expressly agrees to be bound in full, without exception, by all of its provisions. The Website reserves the unilateral right to modify these Terms of Use.

1. ACCESS AND CONDITIONS OF USE OF THE WEBSITE AND PRIVATE AREA

Users may browse and view content offered on the Website freely and without charge. Access to the Website is free for Users.

Users may request to purchase Tickets offered through the Website. Additionally, Users may access a private area by completing the corresponding registration form.

By browsing, using, or viewing content on the Website, the User declares that they are over eighteen (18) years old or, if not, that they have the appropriate authorization from their legal guardians.

1.1. WEBSITE USAGE RULES

It is prohibited—and Users are solely responsible for any consequences—to access or use the Website for illegal or unauthorized purposes, whether for profit or not. In particular, and without limiting the following list, it is prohibited to:

  • i. Use the Website in any manner that may cause damage, interruptions, inefficiencies, or defects in its operation or in the computer systems of third parties;
  • ii. Use the Website to transmit, install, or publish any virus, malicious code, or other harmful programs or files;
  • iii. Use the Website to collect personal data of other Users;
  • vi. Use the Website illegally, contrary to good faith, morality, or public order;
  • v. Register on the Website using a false identity, impersonating third parties, or using a profile or taking any other action that may confuse other Users about the User’s identity;
  • vi. Access without authorization any section of the Website, other systems or networks connected to it, Fourvenues’ servers, or services offered through the Website via hacking, password falsification, or any other illegitimate means;
  • vii. Breach or attempt to breach the security or authentication measures of the Website or any connected network, or security or protection measures inherent to the content offered on the Website;
  • viii. Carry out any action that causes disproportionate or unnecessary saturation of the Website’s infrastructure, systems, or networks, as well as systems and networks connected to the Website;
  • ix. Prevent the normal execution of a service, promotion, or any other activity available through the Website or any of its functionalities, whether by illegally or otherwise altering or attempting to alter access or functionality, or by falsifying results and/or using fraudulent participation methods, through any procedure, and/or via any practice that contravenes or violates these Terms of Use.

1.2. DURATION

The status of User is attributed to any person who browses and views the content offered on the Website without time limitation.

2. REGISTRATION AS A WEBSITE USER

2.1. Registration

Registered Users may access and use the private area of the Website for free by completing the registration form.

To register, Users must click “Sign In” and, if not yet registered, click “Create Account,” providing all required information, including: first name, last name, and email, and accept these Terms and Conditions and Fourvenues’ Privacy Policy.

After completing the registration, the User will receive an email to authorize login through an authentication request. Once completed, the User will be properly registered and have access to the private area.

The User acknowledges that the account is personal and non-transferable.

The User must follow the steps indicated by the Website to log in to their private area.

If login issues occur, Fourvenues provides the email support@fourvenues.com for assistance.

The User agrees to diligently manage their account and not to transfer it to any third party. Users are responsible for safeguarding their credentials and must not allow third-party access. The User is responsible for lawful use of their account and liable for any damages caused by third parties using their credentials.

The User must immediately notify Fourvenues of any unauthorized use, theft, or loss of credentials to cancel them. Until notification, Fourvenues is exempt from liability for misuse by unauthorized third parties.

2.2. Duration

Registered User access begins after providing the required registration data, accepting the Privacy Policy, and these Terms of Use.

Access remains valid indefinitely until the User notifies Fourvenues of account termination at legal@fourvenues.com

3. FUNCTIONALITIES OF THE PRIVATE AREA

Once logged in, the User can:

  • i. View or modify profile data: name, last name, gender, date of birth, email, and optionally add a profile picture;
  • ii. View all Tickets, passes, or reservations, displaying a history of all Tickets purchased by the User.

4. INTELLECTUAL AND INDUSTRIAL PROPERTY

The User acknowledges that Fourvenues exclusively owns all intellectual, industrial, or other rights related to the Website, including reproduction, distribution, public communication, making available, transformation, source code, object code, technical documentation, user manuals, and any related or derived elements.

Acceptance of these Terms of Use does not grant Users any intellectual property rights beyond the right to use the Website under these terms.

The User agrees not to:

  • i. Duplicate, reproduce, sell, rent, license, distribute, or otherwise use the Website software beyond authorized use;
  • ii. Decompile, modify, reformat, translate, reverse engineer, disassemble, or access source code unless expressly permitted by law;
  • iii. Split the Website into separate parts or modules for independent use;
  • iv. Alter or remove intellectual property notices;
  • v. Infringe Fourvenues’ intellectual or industrial property rights;
  • vi. Develop software, applications, or products similar to the private area based on Fourvenues’ intellectual property;
  • vii. Register trademarks, trade names, or other distinctive signs associated with the Website.

Fourvenues may collect information to monitor and defend its intellectual property.

Users authorize Fourvenues to use collected information as evidence in any legal proceedings.

5. LINKS TO OTHER WEBSITES

The Website may contain links to third-party websites, managed by those third parties.

Fourvenues does not control or approve the content, products, or services of these sites and is not liable for their operation, access, data, or content.

Users must report illegal or immoral content on linked sites so Fourvenues can disable the link promptly.

Linking does not imply any relationship, collaboration, or dependency between Fourvenues and the third-party website.

6. LIMITATION OF LIABILITY

Users release Fourvenues from liability for Website interruptions, malfunctions, or content published by Promoters.

7. SUSPENSION AND TERMINATION

Fourvenues may alter, modify, or suspend any Website feature at any time.

8. CONTENT

Fourvenues does not guarantee legality, reliability, or usefulness of third-party content. Users must report illegal content for corrective action.

9. PRIVACY AND DATA PROTECTION

In accordance with Regulation (EU) 2016/679 (GDPR) and Spanish Organic Law 3/2018, Fourvenues is responsible for personal data collected via the Website, processed under the Privacy Policy, which Users must read and consent to.

11. GENERAL

i. Clause headings are for guidance only and do not affect interpretation, qualification, or extension of these Terms of Use.

ii. Fourvenues may modify these Terms of Use, in whole or in part, by publishing changes in the same way as the original Terms or through any type of communication directed to Users.

iii. The Terms remain in force until they are partially or fully modified, at which point the new Terms take effect.

iv. Fourvenues may terminate, suspend, or interrupt access to Website content at any time without prior notice, without Users being entitled to any compensation.

v. After termination, prohibitions on content use in these Terms of Use remain in effect.

vi. If any provision of these Terms is declared null or unenforceable, in whole or in part, by any competent court or authority, it shall not affect the remaining provisions.

vii. Non-enforcement of any right or provision does not constitute waiver, unless expressly acknowledged in writing.

viii. The Terms are retained electronically by Fourvenues and permanently available to Users.

ix. The contract between the User and Fourvenues is formalized in Spanish, which is the language of interpretation for these Terms. x. Users discovering errors during registration must contact Fourvenues through the contact form or email; Fourvenues will provide necessary support and correct identified errors. xi. Unless otherwise stated, communications between the User and Fourvenues must be in writing via email or certified letter to the corresponding addresses.

SECTION TWO – PURCHASE CONDITIONS

These purchase conditions (the “Purchase Conditions”) govern the acquisition by any User of Tickets for Events published on the Website.

Before purchasing any of the Tickets offered on the Website, the User is required to read and accept these Purchase Conditions. By accepting them, the User expressly acknowledges that they are fully bound by them, in their entirety and scope, without exception.

Fourvenues reserves the unilateral right to modify these Purchase Conditions. Therefore, it is the User’s responsibility to periodically read the applicable conditions in force. The temporal validity of these Purchase Conditions coincides with the period of their publication, until they are totally or partially modified, at which point the new amended Purchase Conditions shall enter into force.

It is mandatory that the User who uses, accesses, browses, or purchases the products offered on the Website be of legal age or, failing that, have the corresponding authorization from their legal guardians.

1. PURCHASE OF TICKETS

The User may access the Website and freely and free of charge view a summary of the content of each Event organized by the corresponding Promoters and offered on the Website, as well as the price thereof and its essential characteristics.

Fourvenues shall not be held responsible for the content of the Events published on the Website.

Any User may purchase Tickets for an Event through the Website. To do so, the User must select the Ticket or Tickets they wish to purchase in order to view the purchase price (the “Final Price”).

Once the Final Price is displayed, if the User wishes to proceed with the purchase of the Ticket(s), they must pay the Final Price by credit or debit card, as well as through other available payment methods. Once payment has been successfully completed, the User will receive an email at the address provided for this purpose, confirming the purchase and attaching the Ticket purchased with the QR code necessary to access the corresponding Event.

The User’s data will remain stored by Fourvenues until the purchase has been completed, and for the time necessary for Fourvenues to duly comply with its obligations. The data entered by the User must be true, with Fourvenues being exempt from liability in cases where the User, either voluntarily or involuntarily, enters data that does not correspond to reality.

Fourvenues reserves the right to suspend any order in the event that the payment method used by the User is rejected by the competent authorities.

In certain Autonomous Communities, the legislator has prohibited the street or itinerant sale and resale of Tickets (including season passes), as well as their compensated transfer, and breach of such prohibition constitutes a serious offense. In any case, the resale or commissioned sale of Tickets shall require the prior consent of the Promoter, as well as authorization by the corresponding regional Administration.

In the event that a User chooses to purchase their Ticket outside of the sales channels established by the Promoter, they must be aware that they will not be contracting with a company within the framework of a consumer legal relationship, and therefore will not have the protection that the legislator has provided for consumers. Furthermore, neither Fourvenues nor the Promoters shall be responsible in such cases for any incident or liability arising from such unofficial sales processes or channels.

2. PRICE

The User will know the Final Price of the products purchased prior to payment of the corresponding price. The Final Price will always include VAT and will be expressed in Euros.

Products will be invoiced at the Final Price in force at the time of the order, except in the case of promotions and/or campaigns. Fourvenues reserves the right to apply discounts to the Final Price.

In any case, the Final Price will be shown to the User at the time the actual purchase is made (moment of payment), in accordance with these Purchase Conditions, and the User will receive a link referring to them. In the event that said link refers to Conditions modified after those in force at the time of purchase, the User may request a copy of them by sending an email to legal@fourvenues.com.

3. CONTENT DISPLAY

Once the Final Price has been paid, the User will be able to view the information relating to the Event for which they have purchased Ticket(s) (Promoter’s details, date, time, and location of the Event, admission conditions established by the Promoter, etc.), among others, as well as download the Tickets, which must be presented on the date of the Event in order to gain access. For all of this, the User must have an Internet connection.

4. RIGHT OF WITHDRAWAL AND REFUND POLICY

In providing its services, Fourvenues never acts as the organizer of the Events published on its Website, nor does it participate in any way in any phase of their organization. Consequently, Fourvenues shall not, under any circumstances, be responsible for the cancellation, total or partial, or for any modifications that such Events may undergo, as such decisions ultimately depend on the Promoters themselves.

Furthermore, Fourvenues informs Users that, in accordance with current consumer legislation, the consumer’s right of withdrawal does not apply, as such right is specifically excluded by the applicable legislation regarding the supply of services related to leisure activities, in particular by Article 103(l) of Royal Legislative Decree 1/2007, of 16 November, approving the revised text of the General Law for the Defense of Consumers and Users and other complementary laws.

Without prejudice to the foregoing, Users may request a full or partial refund of the amount paid for the Tickets when the Event is canceled or substantially modified, except in those cases where the cancellation or substantial modification occurs once the Event has begun and is due to force majeure.

For cases in which Users are entitled to request a refund of the amount paid for the Ticket(s), or part thereof, the following provisions shall apply:

  • Total Cancellation of the Event: A total cancellation shall be understood as the definitive and complete cancellation of the Event, provided that such cancellation is not due to force majeure and no new postponed date has been notified. In the event of total cancellation, the User may request a full or partial refund of the purchase price from the corresponding Promoter, and the Promoters must also refund the corresponding management fees incurred by the Users when purchasing the Tickets. Responsibility for such refunds and related claims arising from a total Event cancellation lies with the Promoters, as the Event organizers. Likewise, it shall be the Promoters’ responsibility to refund the corresponding amounts within the deadlines established in each case by applicable state or regional regulations, with Fourvenues not being responsible for refunds made by the Promoters outside the legally established deadlines, which in any case may never exceed fourteen (14) calendar days from the communication of the Event cancellation. Without prejudice to the foregoing, Fourvenues will cooperate as much as possible in the refund processes and will make its Platform available to the Promoters and Users so that the corresponding refunds can be managed through it.
  • Partial Cancellation of the Event: Partial cancellation shall be understood to exist when, in an Event lasting more than twenty-four (24) hours, at least one (1) of the days of the Event is canceled without force majeure. In this case, the User may claim from the Promoter a partial refund of the amount corresponding exclusively to the day or days affected by the cancellation, as well as, where applicable, the corresponding management fees. Without prejudice to refunds being made, as the case may be, through the Website, the Website shall be exempt from any liability related to the refund of amounts corresponding to a partial cancellation, which responsibility shall lie solely with the Promoter, who must make the corresponding refunds within a maximum period of fourteen (14) calendar days from the communication of the partial cancellation of the Event, or, if prior communication has not been possible, from the time the partial cancellation occurred.
  • Substantial Modification of the Event: A “substantial modification” shall be understood as any change that causes the Event to differ substantially from what Users could reasonably expect in general, provided it is not due to force majeure. A change in the start time of the Event shall not be considered a substantial modification. In the event of a substantial modification, Users may choose to confirm their attendance at the modified Event under the new circumstances or, alternatively, request from the Promoter a refund of the price of the Ticket(s) purchased, within the period set for this purpose in each case (Promoters may in no case delay more than fourteen (14) calendar days from the User’s communication of their refund request to process it). Furthermore, Promoters shall be obliged to refund not only the amount paid by Users for the Ticket price but also the corresponding management fees incurred by Users, in accordance with applicable regulations. If the User does not communicate within the established period of fourteen (14) days that they wish to request a refund, it shall be understood that they confirm their order for the modified Event and, consequently, will not be entitled to demand a refund of the Ticket(s) purchased.
  • Price Error: In the event that errors in the Ticket price are detected, the User shall have the right to be informed by the Event Promoter as soon as possible and without undue delay, so that the User may decide whether they wish to continue with the purchase at the correct price (making the corresponding additional payment) or cancel the order. If the User decides to cancel the order, they shall be entitled to a refund of the amount they have paid for the Ticket(s) purchased, including, where applicable, the management fees paid, within fourteen (14) calendar days from the date of communication of the error.

In any of the above cases, Fourvenues’ customer service team will handle communications received from Users regarding such circumstances, responding as quickly and efficiently as possible and attempting to expedite communication between the User and the Promoter in order to achieve the fastest possible resolution in the necessary cases.

In the event that a refund is due to a User, it shall be made to the current account associated with the card used by the User in the Ticket purchase process.

5. “GUARANTEE YOUR TICKET” SYSTEM

Fourvenues offers Promoters the possibility of activating, for the Events where they so wish, the “Guarantee Your Ticket” system, through which end Users may, upon payment of an additional amount to the purchased Ticket(s)—which will be shown in the Final Price before proceeding with payment—request a refund of the amount paid for the Ticket(s) in the event they are ultimately unable to attend the Event in question.

Therefore, and without prejudice to the provisions of the previous clause, in those Events where the Promoter has activated the “Guarantee Your Ticket” system offered by Fourvenues, Users may request such refund of the amount paid for the Ticket(s) if they are ultimately unable to attend the corresponding Event.

To do so, end Users must: (i) send a written request to Fourvenues through the channels indicated during the purchase process; (ii) send such request within the stipulated period, of which the User will be informed in advance during the purchase process; and (iii) provide all information required for this purpose, of which they will also be informed in advance when contracting the “Guarantee Your Ticket” system.

6. LIMITATION OF LIABILITY

By accepting these Conditions, Users declare that they are aware that Fourvenues is released from and shall not be liable to them, by way of example and not limitation, for:

  • i. Any incident related to the Events published on the Website or their organization, including their cancellation, partial modification, substantial modification, or suspension, in accordance with these Conditions;
  • ii. Any incidents and/or errors related to the information on Events published by Promoters on the Website. In this regard, Fourvenues merely reproduces the Event information provided by the Promoters, without having any decision-making power over any of the Event details;
  • iii. Incidents occurring during the holding and course of the Events;
  • iv. Any incident or liability arising from the resale of Tickets, as well as their compensated transfer;
  • v. A Promoter’s failure to comply with its obligations relating to the corresponding activity license or with any other legal obligations that may apply to them;
  • vi. Any modification, alteration, or incident of any kind concerning the price of the Tickets offered for sale by the Promoters;
  • vii. Any content incorporated by Promoters on the Website, as well as information entered by Users themselves in their private area. Both Promoters and Users must refrain from inserting any texts, images, sounds, or messages that are obscene, racist, xenophobic, violent, defamatory, or otherwise infringe any legally protected rights, in particular, and without limitation, the rights of minors, intellectual and industrial property rights, image rights, and privacy;
  • viii. Any content from the Promoters’ websites, as well as all personal data and relationships with third parties they establish, the information they transmit and store, hypertext links, third-party claims, and legal actions that may be triggered regarding intellectual and industrial property, personality rights, and protection of minors;
  • ix. Any failure by Promoters to comply with applicable legislation relating to the operation of hosting services, e-commerce, personal data protection, information society services, copyright, maintenance of public order, as well as the universal principles of Internet use;
  • x. Any practice harmful to third-party rights that may be carried out from Promoters’ websites.

In the event that Promoters commit any of the breaches described above, or any other breach not contemplated in this clause, Users must address the corresponding claims against the Promoters, with Fourvenues not being responsible in any case, without prejudice to Fourvenues always making its best efforts to handle communications it receives in this regard, mediating where possible between Users and Promoters to expedite the management and resolution of such claims.

7. CONTACT

Fourvenues provides the User with a contact email address (in addition to the identification details of the owner of Fourvenues set out above) for the purpose of providing support and assistance, if applicable.

Furthermore, it should be remembered that the User has the contact details of Fourvenues reflected in Section I of these Purchase Conditions.

8. COMPLAINTS SYSTEM

If the User considers that any of their rights have been infringed, Fourvenues suggests that they communicate this through any of the channels enabled in the “Preliminary” section of these Conditions, and undertakes to respond to and address their concerns regarding the alleged infringement of rights.

Upon receiving all the information, Fourvenues may take the necessary measures with the aim of investigating and resolving the situation.

In no case shall the implementation of any measure imply the admission by Fourvenues of any liability whatsoever. Fourvenues reserves the exercise of any right, action, or defense available to it.

9. CONFIDENTIALITY AND DATA PROTECTION

In accordance with the provisions of REGULATION (EU) 2016/679 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, repealing Directive 95/46/EC, and Organic Law 3/2018 of 5 December, on the Protection of Personal Data and guarantee of digital rights, Fourvenues is the data controller for all personal data provided during the use of the Website, which will be processed in accordance with the provisions of the Privacy Policy that Users must read and, where applicable, accept and/or consent to. Information on how to exercise the rights set out in Articles 15 to 22 of Regulation (EU) 2016/679 can be found in said Privacy Policy.

10. APPLICABLE LAW AND JURISDICTION

The sale is understood to be carried out in Spanish territory; therefore, for any interpretative or litigious issues that may arise, Spanish legislation shall apply and, in case of dispute, both parties agree to submit, waiving any other jurisdiction that may correspond to them, to the jurisdiction of the Courts and Tribunals of the consumer’s domicile.

Furthermore, pursuant to the provisions of Regulation (EU) No. 524/2013 of the European Parliament and of the Council, of 21 May 2013, on online dispute resolution for consumer disputes, in the event of any dispute related to the Contract, the Customer may resort to the “Online Dispute Resolution Platform” developed by the European Commission via the following link: http://ec.europa.eu/consumers/odr/
